Terms & Conditions

Scope of Application

These Terms and Conditions (T&C) apply to all orders placed via our online shop by consumers (§ 13 BGB/German Civil Code) and businesses (§ 14 BGB). We do not accept any terms and conditions of the customer that deviate from ours, unless expressly agreed in writing.

Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order.
By clicking the order button, you submit a binding offer. The contract is concluded once we confirm the order by email.
Contract languages are German and English.

Prices and Payment Terms

All prices are final prices in euros and include statutory VAT.
Retention of title: The goods remain our property until payment has been made in full.
Accepted payment methods: Visa, Mastercard, American Express, PayPal, bank transfer.

Delivery

Deliveries within Germany usually take 2–5 business days.
Within the EU, maximum delivery time is 14 days, outside the EU 30 days.
If products are not available, we will inform you without delay.
Any import duties, customs or fees for deliveries outside the EU are borne by the customer.

Right of Withdrawal

Right of Withdrawal Information

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day

on which you or a third party other than the carrier and indicated by you has taken possession of the goods, or
in the case of a contract for several goods ordered under one order and delivered separately: on which you or a third party indicated by you has taken possession of the last good, or
in the case of a contract for the delivery of a good in several partial shipments or pieces: on which you or a third party indicated by you has taken possession of the last partial shipment or piece.

by means of a clear declaration (e.g. a letter sent by post or email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you; in no event will you be charged fees for such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods, unless otherwise offered by us.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Warranty

Statutory warranty rights apply (§§ 437 ff. BGB).
For business customers, the warranty period for newly manufactured goods is 12 months.

Liability

We are liable without limitation in cases of intent, gross negligence, or injury to life, body or health.
In cases of slight negligence, we are only liable for the breach of essential contractual obligations (cardinal duties). Liability is then limited to foreseeable, typical damages.
Any further liability is excluded.

Data Protection

The processing of personal data is carried out in accordance with our Privacy Policy, available at https://knnk-studio.com/privacy-policy/.

Online Dispute Resolution

The European Commission provides an Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For consumers: Mandatory consumer protection provisions of the country where the consumer has his/her habitual residence remain unaffected.
The place of jurisdiction is Berlin, provided the customer is a merchant, legal entity under public law, or public special fund.
Should any provision be invalid, the remainder of the contract shall remain valid.
